Foempies.com is owned by Drie Koningen Shoe BVBA. We are located at Driekoningenstraat 19 2600 Berchem, Belgium. with company number BE0412714412. Foempies.com reserves the right to change these general terms and conditions and the content of its website. For agreements already concluded, the conditions that were valid at the time of the conclusion of the agreement remain in force. Accepting an offer or ordering products means that the customer accepts the applicability of the general terms and conditions. Foempies.com may only deviate from the provisions of these general terms and conditions in writing, in which case the other provisions will remain in full force.
By placing an order, the buyer is deemed to have taken note of these terms and conditions and to agree with them.
The order agreement is governed by Belgian law.
Article 2. Confirmation of your order
If you have placed an order via the website and have provided a correct e-mail address, you will receive a confirmation of receipt which at least contains the following information:
A description of the product purchased by you and the number of products purchased by you;
The total price of your order;
Your name and the address where the product will be sent
Article 3. Transport and Shipping
The risk during the transport of the product ordered by you is for Foempies.com, up to and including the moment of delivery to the delivery address indicated by you.
Article 4. Delivery terms
Foempies.com strives to ship within 1-3 working days after receipt of the order. The shipping time is usually 1 to 3 days, depending on the country of destination.
Although Foempies.com strives to have orders delivered to you as quickly as possible, it is dependent on postal and parcel services for this. Foempies.com cannot be held liable for delays in delivery.
Foempies.com reserves the right to make partial deliveries.
Article 5. Return period
After receiving your order, you have the option of returning the purchase shoes with Foempies.com within 14 days without giving any reason. However, the product(s) must be unopened. For practical reasons, we ask you to notify us by e-mail, in order to be able to follow up on your return shipment.
If you wish to dissolve the agreement pursuant to Article 5.1, you must return the unopened product within 14 days of receipt. You must bear the costs of the return yourself.
Article 6. Complaints and Warranties
6.1 You must make any complaints known to the customer service of Foempies.com (for details see article 7 of these conditions). Foempies.com will try to resolve the complaint within 1-2 working days.
6.2 If Foempies.com is of the opinion that your complaint is justified, the buyer is entitled to request Foempies.com to replace the product with a similar product or get the purchase price refunded.
Foempies.com will process and record your personal, address and order data in a file in order to fulfill the agreement it has entered into with you.
This data will under no circumstances be passed on to third parties without your consent.
The information can be used to send you personally targeted offers from Foempies.com by e-mail or post, provided you have given permission for this.
If you do not appreciate personally targeted offers from Foempies.com, you can let Foempies.com know in writing (via e-mail, letter) or make this known via our section "Account" - "My Account"
Article 9. Retention of Title
All goods delivered to the customer remain the property of Foempies.com until the purchase price has been paid in full.
Article 10. Force majeure/special circumstances
Foempies.com is not obliged to fulfill its delivery obligations if it is prevented from doing so as a result of circumstances that cannot be attributed to its fault. Such circumstances include a business failure, a transport delay, a strike and non-delivery or late delivery by suppliers.
Article 11. Reservation
Foempies.com cannot be held responsible for the unintended provision of incomplete or incorrect information.
Article 12. Prices
The prices quoted are in EURO including 21% VAT.
Article 13. Complaints procedure
Complaints about the implementation of the agreement must be submitted fully and clearly described to the entrepreneur within 2 months after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the period of 14 days with a notice of receipt and an indication when the consumer can expect a more detailed answer.
If the complaint cannot be resolved in mutual consultation, a dispute arises that is subject to the dispute settlement procedure.
In the event of complaints, a consumer should first of all turn to the entrepreneur. It is also possible to register complaints via the European ODR platform (http://ec.europa.eu/odr).
A complaint does not suspend the obligations of the entrepreneur, unless the entrepreneur indicates otherwise in writing.
If a complaint is found to be well-founded by the entrepreneur, the entrepreneur will, at its option, replace or repair the delivered products free of charge.
Article 14. Disputes
Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Belgian law in the court of Antwerp. Even if the consumer lives abroad.
